Gratiq Terms of Service

1. Acceptance of Terms

By accessing or using Gratiq (the "Service"), operated by Smartbee LLC ("we", "our", or "us"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

If you downloaded Gratiq from the App Store, Apple's Standard Licensed Application End User License Agreement also applies. These Terms add to it and do not replace it.

2. Description of Service

Gratiq helps you calculate tips and split bills. The Service includes:

• Receipt scanning using AI image recognition
• Manual amount entry
• Splitting the total among several people
• Tip history stored on your device

3. Disclaimer of Accuracy

Important: Gratiq is a convenience tool. Its calculations and AI receipt reading are for reference and may contain errors.

• AI recognition of receipt amounts may be inaccurate
• Tip suggestions follow general guidelines and may not reflect local customs
• Always check amounts before you pay
• You alone are responsible for the tip you choose to pay

4. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted, error-free or always available.

5. Free Service

Gratiq is free to use and is supported by advertising. There are no in-app purchases. We may modify, suspend or discontinue the Service at any time.

6. User Responsibilities

By using the Service, you agree to:

• Use the Service only for lawful purposes
• Not attempt to interfere with or disrupt the Service
• Not use the Service to scan documents other than receipts
• Check all calculations before making payments

7. Intellectual Property

The Service, including its design, features and content, is owned by Smartbee LLC and protected by copyright, trademark and other intellectual property laws. You may not copy, modify or distribute any part of the Service without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Smartbee LLC is not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or other intangible losses, resulting from:

• Your use of, or inability to use, the Service
• Any errors or inaccuracies in the Service
• Unauthorized access to your data
• Any third-party conduct on the Service

9. Indemnification

You agree to indemnify and hold harmless Smartbee LLC from any claims, damages or expenses arising from your use of the Service or your violation of these Terms.

10. Third-Party Services

The Service relies on third-party services, including Google Gemini (receipt reading), Google AdMob and AdSense (advertising) and Google Analytics (usage statistics). Your use of them is subject to their own terms and privacy policies. See our Privacy Policy for details.

11. Changes to Terms

We may update these Terms. When we do, we will post the new version here and update the date at the top. Material changes take effect 30 days after posting; continuing to use the Service after that means you accept them.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Travis County, Texas.
